Terms of Service
These terms form a binding agreement between you and Percentile. Please read them carefully, especially the sections on subscriptions, disclaimers, limitation of liability, and dispute resolution.

Welcome to Percentile. These Terms of Service (the "Terms") govern your access to and use of the Percentile websites, mobile applications, and related services (together, the "Service"), operated by Percentile ("Percentile," "we," "us," or "our"). By creating an account, taking the diagnostic, purchasing a subscription, or otherwise using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated here by reference.
If you do not agree to these Terms, do not use the Service. If you are using the Service on behalf of a school, district, or other organization, you represent that you are authorized to bind that organization, and "you" includes that organization.
1. Eligibility and student accounts
The Service is designed for students preparing for standardized examinations and for the parents, guardians, teachers, and administrators who support them.
- Age 13 and older. You may create your own account and agree to these Terms only if you are at least 13 years old. By registering, you represent that you are 13 or older.
- Under 13.We do not knowingly allow children under 13 to create individual accounts. A child under 13 may use the Service only where a school or district has provided the consent permitted under the Children's Online Privacy Protection Act (COPPA) as that child's authorized agent, or where a parent has created and supervises the account and consents to this use.
- Minors generally. If you are under the age of majority in your jurisdiction, you may use the Service only with the involvement and consent of a parent, guardian, or authorizing institution, who agrees to be bound by these Terms on your behalf.
- Accurate information. You agree to provide accurate account information and to keep it current. You are responsible for safeguarding your credentials and for all activity under your account. Notify us promptly at support@percentileprep.com of any unauthorized use.
2. The Service and what we provide
Percentile provides AI-assisted, personalized test preparation, including a free full-length diagnostic, adaptive practice, a spaced-repetition review queue, structured lessons, full-length practice tests, predicted-score estimates, and an AI tutor.
- Original content. All practice questions, explanations, and lessons are original works authored in-house with the assistance of artificial intelligence and reviewed for accuracy. They are inspired by the publicly documented content domains and formats of each exam but are not reproductions of any actual exam item.
- Estimates, not guarantees. Predicted scores, percentile estimates, readiness indicators, and admissions data are statistical estimates for guidance only. They are not promises of any particular outcome on an actual examination or in any admissions process. Your real results depend on many factors outside our control.
- Changes to the Service. We continuously improve the Service and may add, modify, or discontinue features. We will not materially reduce the core features of a paid subscription during a term you have already paid for without offering a pro-rata refund of the affected period.
3. Subscriptions, billing, and refunds
The diagnostic and the Info section are free. Access to the full program (Learn, Review, Practice, the AI tutor, and Insights) requires a paid subscription, except where provided through a school or district license or a complimentary grant.
- Plans and pricing. Current consumer pricing for the SAT is $100 per month, $250 for three months, or $750 per year. Pricing for other exams and any changes are shown at checkout before you pay. One subscription covers one exam.
- Auto-renewal. Monthly and annual subscriptions renew automatically at the then-current price until cancelled. You authorize us and our payment processors to charge your payment method at the start of each billing period.
- Cancellation. You may cancel at any time from your account settings or by emailing us. Cancellation stops future renewals; you retain access through the end of the period you have already paid for.
- Refunds. Except where required by law, payments are generally non-refundable, and we do not provide refunds or credits for partially used periods. As a courtesy, we will consider good-faith refund requests made within 14 days of an initial purchase; contact support@percentileprep.com. Statutory rights, including any mandatory cancellation or cooling-off rights in your jurisdiction, are unaffected.
- Mobile purchases. Subscriptions purchased through the Apple App Store or Google Play are billed by, and subject to the refund policies of, those platforms.
- Schools and districts. Institutional licenses (for example, $50 per student per year, subject to a minimum seat count) are governed by these Terms together with any signed order form, license agreement, or data-protection addendum, which control in the event of a conflict. Where card payment is selected, processing fees may be added; invoiced orders are not charged a processing fee.
- Taxes. Prices exclude applicable taxes, which we may collect where required.
4. Acceptable use
You agree not to, and not to help anyone else:
- copy, scrape, harvest, resell, sublicense, or redistribute the questions, explanations, lessons, or other content of the Service, or use them to train a competing model or build a competing product;
- share, resell, or transfer your account or access, or use a single individual subscription for more than one student;
- reverse engineer, decompile, probe, or interfere with the Service, circumvent rate limits or access controls, or attempt to access another user's data;
- use the AI tutor or other features to generate content that is unlawful, harassing, hateful, sexually explicit, or unrelated to legitimate test preparation, or to attempt to extract answer keys outside the normal flow of the Service;
- upload malware, conduct automated access except as expressly permitted, or use the Service to violate any law or the rights of others.
We may suspend or terminate access that violates these rules or that we reasonably believe threatens the security or integrity of the Service or other users.
5. AI tutor and automated content
The Service includes an AI tutor and AI-generated explanations. You understand and agree that:
- AI systems can make mistakes. While we ground the tutor in our reviewed explanations and continuously improve quality, output may occasionally be incomplete or incorrect. Do not rely on it as a substitute for professional, academic, medical, legal, or financial advice.
- You can flag any question or explanation you believe is wrong. Flagged items are automatically pulled from rotation pending review. This feedback loop is central to our quality process, and you agree we may use it to improve the Service.
- Conversations with the tutor are processed by third-party model providers under contractual terms that prohibit using your content to train their general models, and are stored to provide continuity and improve our own explanations as described in the Privacy Policy.
- Fair-use limits may apply to AI tutor usage to keep the Service affordable and available to all users.
6. Intellectual property and your content
Our content. The Service and all content we provide, including questions, explanations, lessons, software, design, and trademarks, are owned by Percentile or our licensors and are protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own test preparation (or, for institutions, for the licensed students) in accordance with these Terms. No other rights are granted.
Your content. You retain ownership of the content you submit, such as your answers, reflections, tutor messages, and any score reports you upload ("User Content"). You grant us a worldwide, royalty-free license to host, process, and use your User Content to operate, secure, personalize, and improve the Service and to produce de-identified and aggregated analytics. We will not publish your individually identifiable User Content except as described in the Privacy Policy or with your consent.
Feedback. If you send us suggestions or feedback, you grant us a perpetual, royalty-free license to use them without obligation to you.
7. Efficacy research and verified scores
We may invite you to join a voluntary, pre-registered efficacy study. Participation is optional, you may withdraw at any time, and any published results use de-identified, aggregated data with confidence intervals, counting only students who complete the program. If you choose to upload an official score report, you represent that it is genuine and that you are entitled to share it.
8. Third-party trademarks and no endorsement
SAT and PSAT/NMSQT are trademarks of the College Board. ACT is a trademark of ACT, Inc. GRE is a trademark of Educational Testing Service (ETS). LSAT is a trademark of the Law School Admission Council (LSAC). Percentile is not affiliated with, endorsed by, or sponsored by any of these organizations. We reference these marks only to describe the exams for which we provide independent preparation.
9. Disclaimers
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT PREDICTED SCORES OR ESTIMATES WILL BE ACCURATE, OR THAT USING THE SERVICE WILL PRODUCE ANY PARTICULAR SCORE OR ADMISSIONS OUTCOME.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, PERCENTILE AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR ONE HUNDRED U.S. DOLLARS. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
11. Indemnification
You agree to indemnify and hold harmless Percentile and its officers, employees, and agents from any claims, damages, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right. This does not apply to the extent a claim arises from our own gross negligence or willful misconduct, or where you are a consumer and applicable law prohibits such indemnification.
12. Suspension and termination
You may stop using the Service at any time and may request deletion of your account. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Service or other users. On termination, your license to use the Service ends; sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.
13. Governing law and dispute resolution
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules, except that mandatory consumer-protection laws of your home jurisdiction continue to apply.
Informal resolution first. Before filing any claim, you agree to contact us at legal@percentileprep.com and try in good faith to resolve the dispute for at least 30 days.
Arbitration and class-action waiver. Where permitted by law, any dispute that cannot be resolved informally will be resolved by binding individual arbitration rather than in court, and you and we waive the right to a jury trial and to participate in a class action. You may opt out of arbitration within 30 days of first accepting these Terms by emailing us. Nothing here prevents either party from bringing a claim in small-claims court or seeking injunctive relief for intellectual-property misuse. These provisions do not apply where prohibited by law, including for certain consumers and public-sector institutions.
14. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will provide reasonable notice, such as by email or an in-product notice. Changes take effect when posted, and your continued use of the Service after that constitutes acceptance. If you do not agree to a change, stop using the Service and, if applicable, cancel your subscription.

These Terms, together with the Privacy Policy and any applicable order form, are the entire agreement between you and Percentile regarding the Service. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
